These Terms of Service ("Terms") govern your access to and use of the website qualityfy.com and the software platforms and services provided by Qualityfy Technologies Private Limited ("Qualityfy", "we", "us", "our"), including QCnomics (qcnomics.com) and Qualityfy (qualityfy.in) (together, the "Services"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
"Customer" means the organisation that subscribes to the Services. "User" means an individual authorised by a Customer to access the Services. "Content" means data, documents, and information submitted through the Services.
You must be at least 18 years old and authorised to bind your organisation to these Terms. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us promptly of any unauthorised use.
Qualityfy provides software-as-a-service tools for laboratory and hospital quality management and accreditation. We may add, modify, or discontinue features from time to time to improve the Services. We aim for high availability but do not guarantee uninterrupted access.
You agree not to: (a) use the Services unlawfully or in breach of any regulation; (b) attempt to gain unauthorised access to the Services or other accounts; (c) interfere with or disrupt the integrity or performance of the Services; (d) reverse engineer, copy, or resell the Services except as permitted by law; or (e) upload malicious code or infringing, unlawful, or harmful content.
As between the parties, the Customer retains all rights to its Content. The Customer grants Qualityfy a limited licence to host and process Content solely to provide and support the Services. The Customer is responsible for the accuracy and legality of its Content and for obtaining any consents required for data it submits, including patient data. Our handling of personal data is described in our Privacy Policy.
The Services, including all software, design, text, and trademarks, are owned by Qualityfy or its licensors and are protected by law. Except for the limited right to use the Services under these Terms, no rights are granted to you.
The Services may integrate with or link to third-party services (such as payment gateways and analytics). Your use of those services is governed by their own terms, and we are not responsible for them.
The Services are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. The Services are tools that support quality and accreditation processes and do not constitute clinical, legal, or professional advice.
To the maximum extent permitted by law, Qualityfy shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of data, profits, or goodwill. Our total aggregate liability arising out of or relating to the Services shall not exceed the fees paid by the Customer for the Services in the twelve (12) months preceding the event giving rise to the claim.
You agree to indemnify and hold Qualityfy harmless from claims, losses, and expenses arising from your Content, your use of the Services, or your breach of these Terms.
These Terms apply for as long as you use the Services. We may suspend or terminate access for breach of these Terms or non-payment. Upon termination, your right to use the Services ceases; provisions that by their nature should survive will survive. Data handling on termination is addressed in the applicable subscription agreement and our Privacy Policy.
These Terms are governed by the laws of India. The courts at Kanpur, Uttar Pradesh shall have exclusive jurisdiction, subject to any applicable arbitration or dispute-resolution terms in a signed agreement.
We may update these Terms from time to time. The "Last updated" date reflects the latest revision. Continued use of the Services after changes take effect constitutes acceptance.
